DMCA Policy for Onion Mashed Potatoes

Onion Mashed Potatoes respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we have adopted the policy below concerning copyright infringement on our website and services. This policy provides a framework for copyright holders to notify us of alleged infringements and for users to respond to such notices.

It is our policy to respond expeditiously to legitimate notices of alleged copyright infringement that comply with the DMCA and other applicable intellectual property laws. Upon receipt of a valid notice, we will take appropriate actions, which may include removing or disabling access to the infringing material.

Filing a DMCA Notice

If you believe that your copyrighted work has been copied and is accessible on Onion Mashed Potatoes' services in a way that constitutes copyright infringement, you may submit a written DMCA Notice to our designated Copyright Agent. Please note that any misrepresentation of material facts in a written notification may subject the complaining party to liability for damages, including costs and attorney's fees incurred by Onion Mashed Potatoes or the alleged infringer, if we are harmed by such misrepresentation.

Filing a DMCA Counter-Notification

If you believe that material you posted on Onion Mashed Potatoes was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with our Copyright Agent. For your counter-notification to be effective under the DMCA, it must include substantially the following:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location (e.g., URL(s)) at which the material appeared before it was removed or disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which Onion Mashed Potatoes may be found, and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.
